4. Products & Availability

Candellaass sells handcrafted candles, fragrance products, gift items, and home décor products.

All products are subject to availability. Candellaass reserves the right to limit quantities, discontinue products, change product details, or refuse orders for any product at any time without prior notice.

We do not guarantee that any product shown on the website will always be available.

5. Orders & Acceptance

All product listings on our website are an invitation to offer. When you place an order, you are making an offer to purchase the selected products.

Candellaass reserves the right to accept, reject, cancel, hold, or modify any order at its sole discretion. This may happen due to stock issues, pricing errors, payment problems, suspected fraud, courier limitations, incorrect information, or any other business reason.

An order is confirmed only after successful payment and acceptance by Candellaass.

Once confirmed, all sales are final, except as stated in our Refund & Return Policy.

6. Custom, Personalised & Bulk Orders

Custom, personalised, corporate, bulk, and made-to-order products are made specially for the customer.

Such orders cannot be cancelled, returned, exchanged, or refunded once production, design work, procurement, packaging, or preparation has started.

Customers are responsible for checking and approving names, spellings, dates, messages, logos, artwork, colours, quantities, and other custom details before confirmation.

Candellaass shall not be responsible for mistakes in details provided or approved by the customer.

Any changes requested after confirmation may be accepted or rejected by Candellaass and may involve extra charges.

7. Cancellation Policy

Orders may be cancelled only before processing or production begins, and only if approved by Candellaass.

Once an order has been processed, customised, packed, produced, or dispatched, cancellation is not possible.

Candellaass may cancel any order due to stock issues, payment failure, pricing errors, suspected fraud, courier limitations, or any other business reason.

8. Processing Time

Standard orders are generally processed within 2–5 business days.

Custom, bulk, festive, personalised, or made-to-order products may take longer.

Processing timelines are estimates only and may vary depending on order volume, product availability, festival season, courier pickup, and customisation requirements.

9. Product Information & Handmade Variations

Candellaass products are handcrafted. Slight variations may occur in colour, size, texture, design, shape, finish, fragrance strength, wax finish, decorative placement, or appearance.

Product images are for reference only. Actual products may vary slightly due to lighting, photography, screen settings, handmade finishing, wax behaviour, fragrance oils, pigments, and raw material differences.

Such minor variations are not defects and do not qualify for return, refund, exchange, cancellation, or legal claim.

10. Fragrance, Colour & Material Disclaimer

Fragrance strength, colour tone, wax finish, and decorative elements may vary from batch to batch.

Some fragrances may feel stronger or milder depending on room size, temperature, ventilation, wax type, and method of use.

Colours shown on the website may differ slightly from the actual product due to screen settings and lighting.

Candellaass does not guarantee exact colour, fragrance throw, texture, or finish matching unless agreed in writing.

11. Product Use & Candle Safety Disclaimer

Candellaass products are lifestyle, gifting, fragrance, candle, and home décor products.

Candles contain an open flame when lit and must be used carefully. Customers must read and follow all safety instructions given with the product or packaging.

Never leave a burning candle unattended. Keep candles away from children, pets, curtains, paper, fabric, furniture, electrical items, and flammable materials. Always place candles on a stable, heat-resistant surface.

Candellaass shall not be liable for injury, accident, fire, allergic reaction, property damage, loss, or harm caused by misuse, negligence, unsafe handling, failure to follow safety instructions, or use against the intended purpose.

Customers use, burn, store, and handle the products at their own risk.

12. Allergy & Sensitivity Disclaimer

Customers are responsible for checking product suitability before use. If you are sensitive to fragrances, waxes, colours, or decorative materials, please avoid use or contact us before ordering.

Candellaass shall not be liable for allergies, irritation, headaches, breathing discomfort, skin reactions, or any medical condition caused by product use or fragrance exposure.

13. Pricing, Billing & Payments

All prices are listed in Indian Rupees (INR), unless stated otherwise.

Prices may change at any time without prior notice. Prices shown online may differ from prices offered through exhibitions, WhatsApp, Instagram, physical stores, third-party platforms, or custom quotations.

Payment must be made in full at checkout or as agreed for custom and bulk orders.

By providing payment details, you confirm that you are authorised to use the selected payment method.

Applicable taxes, including GST where applicable, shall be charged as per Indian law.

14. Payment Responsibility & Fraudulent Transactions

By completing a purchase, you confirm that the payment method used belongs to you or that you are legally authorised to use it.

All funds used for purchase must be lawful and must not be obtained through fraud, theft, unauthorised use, money laundering, or any illegal activity.

Candellaass shall not be responsible for unauthorised, illegal, or fraudulent payments made by any customer or third party.

In case of payment dispute, chargeback, fraud investigation, or unlawful transaction, the customer agrees to cooperate and indemnify Candellaass against any loss, penalty, claim, fee, chargeback cost, or legal expense.

Candellaass reserves the right to cancel, hold, verify, block, or report any suspicious order or payment without prior notice.

15. Shipping & Delivery

Orders are shipped as per our Shipping Policy.

Currently, Candellaass ships within India only, unless otherwise agreed in writing.

Delivery timelines are estimates only and are not guaranteed. Candellaass shall not be responsible for delays caused by courier partners, incorrect address, remote location, weather, strikes, festivals, high order volume, customs, government restrictions, natural disasters, or events beyond our control.

Once the product is handed over to the courier or delivery partner, risk of loss or damage passes to the customer.

Candellaass is not responsible for courier delays, failed delivery attempts, customer unavailability, address errors, or delays after dispatch.

16. Incorrect Address & Failed Delivery

Customers are responsible for providing correct and complete shipping details, including name, phone number, address, pin code, landmark, and delivery instructions.

Candellaass shall not be responsible for delay, loss, non-delivery, return-to-origin, or extra cost caused by wrong, incomplete, or unavailable shipping information.

If an order is returned due to incorrect address, customer refusal, customer unavailability, failed delivery attempts, or non-acceptance of delivery, reshipping charges shall be paid by the customer.

No refund shall be given for failed delivery caused by customer error or non-cooperation.

17. Returns, Refunds & Exchanges

Our Refund & Return Policy applies to all return, refund, replacement, and complaint requests.

Except as clearly stated in that policy, all sales are final.

Candellaass does not accept returns, refunds, or exchanges for reasons such as minor handmade variations, colour difference, fragrance preference, change of mind, courier delay, wrong address given by customer, or improper product use.

For wrong or missing items, customers must follow the process stated in our Refund & Return Policy, including submitting a proper unboxing video within the required time.

18. Intellectual Property

All website content, including the Candellaass name, logo, product images, photographs, designs, text, graphics, videos, labels, packaging designs, artwork, layout, and branding, belongs to Candellaass or is used with permission.

You may not copy, reproduce, modify, distribute, upload, publish, sell, imitate, or commercially use any Candellaass content without written permission.

Unauthorised use may result in legal action.

19. Customer-Provided Artwork, Logos & Designs

For custom orders, if you provide any name, logo, design, artwork, photo, message, brand element, or copyrighted material, you confirm that you own it or have permission to use it.

You agree to protect and indemnify Candellaass from any claim, dispute, loss, damage, or legal action arising from customer-provided content.

Candellaass is not responsible for checking ownership or legality of customer-submitted material.

20. Reviews, Photos & User Content

By sharing reviews, photos, videos, testimonials, feedback, tags, or other content with Candellaass through our website, WhatsApp, Instagram, Facebook, email, or any other platform, you allow Candellaass to use, repost, edit, display, and share such content for marketing, website, promotional, and social media purposes.

Candellaass may remove or refuse to display content that is offensive, misleading, unlawful, abusive, or harmful to our brand.

21. Offers, Discounts & Coupons

Offers, discounts, coupon codes, free gifts, sale prices, and special deals may be changed, withdrawn, cancelled, or modified at any time without prior notice.

Discounts cannot be combined unless clearly stated.

Candellaass may cancel orders where coupon misuse, technical error, pricing error, or fraudulent use is suspected.

To the fullest extent permitted by law, Candellaass, its owners, employees, affiliates, suppliers, partners, or service providers shall not be liable for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages.

This includes injury, fire, property damage, allergic reaction, loss of profits, loss of revenue, loss of data, replacement costs, emotional distress, delay, or business interruption.

To the maximum extent permitted by law, Candellaass’s total liability for any order, product, service, or claim shall not exceed the amount actually paid by the customer for the specific order giving rise to the claim.

28. Force Majeure

Candellaass shall not be liable for any delay, failure, loss, damage, or non-performance caused by events beyond our reasonable control.

This includes natural disasters, fire, flood, earthquake, pandemic, lockdown, war, riots, strikes, government restrictions, courier shutdowns, supply shortage, internet failure, payment gateway failure, transport disruption, accidents, or any other force majeure event.

29. Indemnity

You agree to indemnify and protect Candellaass, its owners, employees, affiliates, suppliers, and service providers from any claims, losses, damages, liabilities, penalties, costs, or expenses arising from:

• Fraudulent or unlawful payments;

• Customer-provided artwork, logos, images, or content;

• Improper use, storage, handling, or burning of products;

• False claims, chargebacks, or disputes.

31. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Subject to the arbitration clause below, the courts at Ujjain, Madhya Pradesh, shall have exclusive jurisdiction over any dispute related to these Terms, our website, products, services, or orders.

You agree not to participate in any class action, collective claim, or representative proceeding against Candellaass.

32. Dispute Resolution & Arbitration

In case of any dispute, both parties shall first try to resolve the matter amicably within 30 days.

If the dispute is not resolved, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996.

The arbitration shall take place in Ujjain, Madhya Pradesh. The language of arbitration shall be English.

The arbitrator shall be mutually appointed by both parties. If both parties cannot agree, the appointment shall be made as per applicable law.

The decision of the arbitrator shall be final and binding. Each party shall bear its own costs unless directed otherwise by the arbitrator.

33. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts shall continue to remain valid and enforceable.

34. Waiver

If Candellaass does not enforce any right or provision of these Terms, it shall not be considered a waiver of that right or provision.

35. Entire Agreement

These Terms & Conditions, along with our Privacy Policy, Shipping Policy, and Refund & Return Policy, form the complete agreement between you and Candellaass regarding your use of our website and purchases.

Any previous communication, discussion, or agreement is replaced by these Terms, unless agreed in writing by Candellaass.

36. Changes to Terms

Candellaass may update, modify, or replace these Terms & Conditions at any time.

The latest version will always be posted on our website. Your continued use of the website or purchase from Candellaass after changes means you accept the updated Terms.
